ORDER ON MOTION TO DISMISS

The defendants having filed their Motion to Dismiss herein on April 23, 1999, and the parties having briefed the matter and the matter having been heard by the Court and the Court having filed its Memorandum Opinion of even date herewith, it is hereby

ORDERED that the defendants Motion to Dismiss is sustained as to the Commonwealth of Kentucky, the Commonwealth of Kentucky Public Protection and Regulation Cabinet and as to Count VI and Count VII of the Complaint and so much of Count IX as alleges violation of the Constitution of the Commonwealth of Kentucky; and it is further

ORDERED that the said Motion to Dismiss is overruled in all other respects.
